Acuta Capital Partners, LLC (“Acuta”) recognizes and respects the privacy concerns of its clients and investors. Acuta is committed to protecting its clients’ and investors’ privacy. This privacy notice explains the privacy policies of Acuta. Acuta does not disclose any non-public personal information about clients or investors or former clients or investors to anyone, except as permitted by law or as described below.

Acuta collects non-public personal information about clients and investors (such as their name, address, social security number, account balance, redemption or withdrawal history, assets, income, occupation, or other personally identifiable financial information) from the following sources:

  • Information received from clients and investors or, if applicable, their financial intermediary on subscription agreements, investor questionnaires, or other forms;

  • Information about transactions with Acuta, its affiliates, or others; and

  • Information is received through correspondence and communication from clients or investors with Acuta, its affiliates, or others.

In order to service clients and investors and effect certain transactions, Acuta may provide clients’ or investors’ personal information to its affiliates and other financial service providers that assist Acuta in servicing clients and investors and have a need for such information, such as a broker-dealer, fund administrators, custodians, banks or back-office services firms. Acuta may also provide these financial service providers and the funds in which it invests with clients’ or investors’ personal information for purposes of complying with any regulatory or legal requirement, including without limitation the free-riding and withholding rules of FINRA. Acuta does not otherwise provide information about clients to outside firms, organizations, or individuals except to Acuta’s attorneys, accountants, and auditors and as permitted by law.

Acuta restricts access to non-public personal information about clients and investors to its members, employees, and consultants who need to know that information to provide investment products or services to clients and investors. Acuta maintains physical, electronic, and procedural safeguards that comply with federal standards to guard clients’ and investors’ personal information.

In the event that a client or investor invests through a financial intermediary, including, but not limited to, a broker-dealer, bank, or trust company, the privacy policy of the financial intermediary will govern how non-public personal information will be shared with non-affiliated third parties by that entity.
